§1. GENERAL INFORMATION
1.1. The online shop www.missogno.com is run by a company named MS Notion Spółka Cywilna Marlena Brykała, Sabina Stańczyk with its headquarters in Dębica, address: ul. Strażacka 10/66, 39-200 Dębica, NIP [Taxpayer Identification Number]: 8722449044, REGON [National Business Registry Number]: 528721021, contact email: : contact@missogno.com
1.2. This Terms & Conditions outlines how to use the store www.missogno.com, including the process of ordering, delivering products, payment methods, Customers right to withdraw from the agreement and complaint and returns handling procedures.
1.3 The Customer may contact the MISSOGNO Store via email: contact@missogno.com, the contact form available on the Store’s website (missogno.com/contact) or in writing (address: ul. Strażacka 10/66, 39-200 Dębica, Poland).
§ 2. KEY DEFINITIONS
2.1. Seller – MS Notion Spółka Cywilna Marlena Brykała, Sabina Stańczyk based in Dębica, address: ul. Strażacka 10/66, 39-200 Dębica, entered in the register of entrepreneurs under NIP [Taxpayer Identification Number]: 8722449044, REGON [National Business Registry Number]: 528721021, e-mail: contact@missogno.com
2.1.1. Store – MISSOGNO Online Store operating via the website at the address: www.missogno.com allowing the Customers to order products via the Internet.
2.1.2. Customer – a natural person having full legal capacity to conclude legal acts, who concluded or intends to conclude a Sales Agreement with the Seller which is not directly connected with his or her business or professional activity.
2.1.3. Product – a movable property available at the Online Store: missogno.com offered for sale by the Seller;
2.1.4 Order – the Customer’s declaration made through the Store, that he wish to conclude a Sale Agreement between him and the Seller;
2.1.5 Order Form – the Electronic Service, which is an electronic form available for Customers to place an order. It makes it possible for the Customer to place an order, by adding the Products to the electronic cart and specifying the terms of executing Sales Agreement (taking into account the delivery and payment methods).
2.1.6 Sale Agreement – it is a contract between the Customer and the Seller via the website www.missogno.com It is executed once the Customer fulfills the order form.
2.1.7 Confirmation of the Sale Agreement – it is an email sent from MISSOGNO Store to the Customer, to the provided email address once the order has been placed.
2.1.8 Business Day – days from Monday to Friday, excluding statutory holidays.
2.1.9 Delivery – means the act of providing the Customer with the products specified in the order by the Seller, through the Supplier.
2.1.10. Supplier – refers to the entity with which the Seller cooperates in providing the delivery of the ordered products.
2.1.11 Newsletter – free electronic distribution service, provided by the Seller via e-mail, which allows Customers to automatically receive messages, including information about offers, promotions and news in the MISSOGNO Online Store.
2.1.12 Terms – these Terms & Conditions of MISSOGNO Store
2.1.13 Email address: contact@missogno.com or contact form: missogno.com/contact is available for the Customer to contact with the Store. The Customer may also contact the Seller by sending writing to: ul. Strażacka 10/66, 39-200 Dębica, Poland.
§ 3. PERSONAL DATA PROTECTION
3.1. The protection of customers’ personal data is governed by the Privacy Policy, which is part of these Terms & Conditions.
§ 4. USING ELECTRONIC SERVICES
4.1. Electronic services available at missogno.com can be used if the Customer has
a) an email address
b) access to the Internet
c) browser for viewing websites.
4.2 Technical requirements which are crucial for cooperation with the Service Providers data communication systems
4.2.1. Web browsers like Chrome, Opera, Firefox, or Edge possible the newest versions. To ensure the proper functioning of the Store, the Customer needs to accept cookies.
4.2.2 Outdated browsers may limit access to some features of the Store.
4.3. Accurate and truthful information must be provided by customers. The Store is not responsible for issues arising from false information.
4.4. Providing illegal content via the Store is strictly prohibited.
4.5. Customers must use the Store lawfully, respecting the rights and personal data of the Seller and other users.
4.6. In case of any complaints about the provision of electronic services, the issues may be submitted

4.7. Upon receiving the complaint, the Store will send a response within 14 days to the email address given by the Customer.
4.8. The Seller is not responsible for disruptions caused by unauthorized actions from others, technical issues with the Customer’s setup, or interruptions due to force majeure.
§ 5. PLACING ORDERS
5.1. The Store offers products for sale online at the website www.missogno.com
5.2. Orders are placed by completing the Order Form, selecting products, and entering necessary details
5.3. To place an order, the Customer selects a product and then fills out the order form, providing:
5.3.1. address details including: first name, last name, country, street and house or apartment number, zip/postal Code, phone number and email address, the delivery method and comments to the order (optional),
5.3.2. the payment method and the final confirmation of the order by acceptance of Terms and Privacy Policy and selecting the “Place order” option.
5.4. Customers receive an email confirmation of their order once it has been placed.
§ 6. EXECUTION OF SALES AGREEMENT
6.1 All products in the Store are new, legally available on the market, and free from physical and legal defects.
6.2. Products are sold accepting only EUR currency. Prices include VAT but exclude delivery and potential customs fees.
6.3. If a product is unavailable, customers will be notified and may choose a substitute product or cancel the order.
6.4 Customers are informed of the total cost, including taxes and delivery, before finalizing an order.
6.5. Shipping costs will apply unless stated otherwise in the sales agreement. For orders outside the European Union, the Customer, as the importer, may have to pay extra customs fees and import duties.
6,6 . The Store is not liable for delays due to customs, force majeure, incorrect addresses, or inability to contact the customer.
6.7 Order processing, including packaging and dispatch, takes up to 5 business days from payment receipt, except for customized items, which may take up to 7 weeks.
6.8. The order is delivered to the address provided by the Customer at Checkout Form.
6.9. 6.10. In case of any delays or non-delivery that occur due to the absence of the authorized recipient, incorrect or missing delivery information, extended customs clearance processes or force majeure events, but also the inability to contact the Customer via the provided phone number or email address the Seller will not be responsible.
6.11. The Customer will be charged additional shipping costs if:
a) does not collect the Products he ordered, the order will be returned to the Seller;
b) reject to pick the order and fail to prepare a shipping damage report with the carrier.
6.12. The order needs to be checked by the Customer upon the delivery. In the rare event of damage or missing items, the Customer is obliged to take proper steps to determine the Supplier’s liability and prepare a damage report with the Supplier.
6.13. The available payment methods are:
a) Traditional Bank Transfer to the Seller’s bank account:

b) Payments by PayPal, Debit & Credit Card and Google Pay.
6.14. All payments need to be made by the Customer within 3 days from the day the order was made.
6.15. The order will be processed once the whole amount for order is acknowledged in the Seller’s bank account or upon receipt of confirmation from the payment operator verifying the successful transaction. The differences between the shipping address specified during order placement and the address provided to the payment operator may result in order cancellation. In such instances, the Customer may be requested to place a new order.
6.16. The Seller provides a one year warranty on the products and delivers a warranty card to the Customer along with the product. However, the warranty does not exclude the Customer’s right to make a complaint in case of product’s defects.
6.17. By publishing these Term&Conditions on the website and sending a Customer a message containing the confirmation of entry to the sales agreement, the content of the concluded Sales Agreement is shared, secured and recorded. It is also secured and recorded in the Seller’s IT system.
§ 7. RIGHT TO WITHDRAW
7.1. Customers may proceed with the withdrawal from the contract within 14 days under the Consumer Rights Act of May 30, 2014.
7.2. The withdrawal period ends 14 days after the Customer receives the product. The goods should be returned to the address ul. Strażacka 10/66, 39-200 Dębica.
7.3. The Customer is responsible for covering the transportation costs for returning the product to the store.
7.4 The Customer cannot cancel the Sales Agreement if the product has been used or has been in direct contact with a pet. This is because the product cannot be sold as new anymore due to changes it might have undergone and for hygiene reasons.
7.5. The Customer is responsible if the product loses value because they handled it more than needed to check its features and functionality
7.6. To withdraw, customers must send a clear statement by mail to the store’s address: ul. Strażacka 10/66, 39-200 Dębica or to email address: contact@missogno.com before the withdrawal deadline (14 days). The Customer may use the withdrawal form template available below or at the Returns & Warranty Policies section on the Store’s website, but it is not mandatory.
7.7 The Store will refund all payments, including the cheapest possible delivery cost, within 14 days of receiving the withdrawal notice. The Store retains the right to delay refund until the product arrives at its warehouse.
7.8. The Store will make a refund to the Customer in the same way they paid originally, unless the Customer asks to use a different way. There won’t be any extra fees for the refund.
§ 8. COMPLAINTS AND RETURNS
8.1. The Customer has the right to file a warranty complaint if the product has any physical or legal defects.
8.2. The warranty of the products is valid within 12 months from the date of delivery of the product to the Customer.
8.3. The Customer’s complaint should include:
a) the Customer’s first and last name and email address
b) the proof of purchase of the product from the Store or the warranty card added to the package on the day of sale
c) the description of the defect and serial numbers from the authenticity certificate
d) any additional materials that may be helpful during the procedure such as videos or photos
8.4. Complaints should be submitted via the Store’s website Complaint Form, email contact@missogno.com, or by mail to ul. Strażacka 10/66, 39-200 Dębica, Poland.
8.5. The Store is accountable for any defects in the product as per applicable legal rules.
8.6. The Store is obligated under warranty for any physical defects present at the time the risk is transferred to the Customer which stem from an inherent issue with the item at the time of sale.
8.6. If the Store confirms the product is defective according to clause 5.6, the Customer, using warranty rights, must return the faulty product to the Store’s warehouse at the Store’s cost.
8.7. If a defect occurs in the product, the Customer can ask the Store to fix the issue, exchange the faulty item for a new one that is flawless, or receive a discount in price. If the flaw is substantial, the Customer has the option to terminate the agreement.
8.8. The Store will review complaints within 14 days and inform customers of the results.
8.9. The Buyer should follow the manufacturer’s and Seller’s instructions regarding how to use and take care of the product, especially those found in the user manuals and care labels attached to the cover.
8.10. Claims for physical defects of a product exclude:
– damages caused by rough pet use. This includes but is not limited to: bites, rips, burns, tears, excessive scratching, stains and liquid/moisture damage (unless the waterproof lining kit was used);
– tear as a result of improper way of washing and other than intended use;
– natural color or texture changes in materials associated with long-term use;
– discoloration resulting from exposure to sunlight;
– yellowing of the foam as a natural characteristic of the product. The foam loses its color and this is a natural process and does not affect the quality of the foam;
– wood cracking as a result of exposure to heat;
– plumping of wood as a result of exposure to water;
– damage caused by improper use or not washing according to the manufacturer’s recommendations;
– damages occurred due to keeping the product outdoors.
§ 9. FINAL PROVISIONS
9.1. Agreements concluded by the Seller’s Store are concluded pursuant to the Polish law in English language.
9.2. To control the way the website missogno.com is used, the Store uses cookies. The Privacy Policy is an integral part of these Terms&Conditions and includes the details about them.
9.3. Changes in Terms & Conditions.
9.3.1. The Store has a right to provide changes in the Terms&Conditions due to important reasons.
9.3.2. The changes to the Terms&Conditions are effective no later than 7 days from the date they were published on the Store’s website.
9.4. The Customer has free access to the Terms and Conditions all the time via:
a) Store’s website
b) any other form allowing: downloading, printing or saving them.
9.5. If the sale agreement was concluded before the Terms&Conditions have been updated, it will be executed according to the Terms&Conditions that were applicable when entering in such a sale agreement.
9.6. The Store displays content protected by copyrights and other intellectual property rights, like photos, graphics, and logos. Users must respect these rights owned by the Store and third parties.
9.7. The Customer of the Store or anyone visiting the Store’s website bears full responsibility for not complying with the § 9 provisions.
9.8. Any disputes related to the Store’s services will be resolved by the competent Polish common courts.
MISSOGNO Pawtastic Dreams Giveaway Regulations
§1. GENERAL INFORMATION
1.1 The giveaway is organized by online shop www.missogno.com, run by a company named MS Notion Spółka Cywilna Marlena Brykała, Sabina Stańczyk with its headquarters in Dębica, address: ul. Strażacka 10/66, 39-200 Dębica, NIP [Taxpayer Identification Number]: 8722449044, REGON [National Business Registry Number]: 528721021, contact email: contact@missogno.com, hereinafter referred to as the “Organizer”.
1.2.The giveaway is in no way supported, sponsored, organized, or associated with Instagram. Instagram is not responsible for the giveaway. Any questions, comments, or complaints should be directed to the Organizer, not to Instagram. The Organizer undertakes to release Instagram from any liability towards each Giveaway Participant who directs a claim against Instagram related to this Giveaway.
1.3. Organizer provides the prize resulting from the Giveaway. The jury members are the owners of MS Notion s.c.: Marlena Brykała and Sabina Stańczyk.
1.4. The giveaway is carried out following the rules described in the following Giveaway regulations and applicable Polish law.
§2. GIVEAWAY PARTICIPATION TERMS
2.1. The giveaway begins on 26th of August at 10:00, and ends on 31st of August at 23:59:59 Central European Time.
2.2. Participation in the giveaway is free of charge and voluntary.
2.3. The winner of the giveaway is chosen by the Organizer for the best and the funniest (according to the Organizer) comment which is a response to the giveaway question: “What is the funniest thing your pet has done to get your attention?” The public announcement of results will be made no later than on the 2nd of September 2024.
2.4. The winner of the giveaway will be notified of the win via Direct Message via Instagram on the 2nd of September 2024 and publicly on Instagram story on the Organizer’s profile: @missognoofficial
2.5. The winner will receive one bed of his/her choice (color and size) available on the store www.missogno.com excluding products from the wooden collection (Lotus Oak, Lotus American walnut, Hoya Oak).
2.6. A participant may participate in the giveaway only once.
2.7. The Organizer and at the same time the Administrator of the profile @missognoofficial is obliged to remove comments/posts that violate the information of these Giveaway regulations.
2.8. To participate in the giveaway the Participant must complete the following giveaway task:
2.8.1. follow the Organizer’s Instagram profile: @missognoofficial
2.8.2. answer by himself/herself the giveaway question: What is the funniest thing your pet has done to get your attention?
2.8.3. invite 3 people to join the fun by tagging them in the comments under the giveaway post on the Instagram.
2.8.4. share the giveaway post on his/her IG stories and tag profile @missognoofficial

2.10. The giveaway will be conducted exclusively online, on Instagram on the Organizer’s profile: @missognoofficial
2.11. Only participants who completed the giveaway task during the giveaway period will be eligible to participate in the Giveaway.
2.12. An individual (Consumer within the meaning of Article 22 of the Civil Code), hereinafter referred as the Participant, may participate in the giveaway if:
2.12.1. is over 18 years of age and has full legal capacity (people under 18 years old can participate in the giveaway only with the consent of their legal guardian);
2.12.2. completed the giveaway task;
2.12.3. has an active account (profile) on the Instagram;
2.12.4. has read these Regulations and accepted their content and agreed to the processing of personal data for the purpose of conducting the giveaway by entering the giveaway;

2.13. Excluded from participating in the giveaway are:
2.13.1. entities and employees of entities providing services to the Organizer under civil law contracts related to organizing the giveaway under civil law contracts related to organizing the giveaway;
2.13.2. family members of the Organizer (spouses, siblings, parents etc.)
2.14. Only individuals who meet the conditions specified in §2. subsec. 2.11 of the Giveaway Regulations may participate in the giveaway.
2.15. In case of failure to meet any of the regulations in 2.8. (2.8.1 – 2.8.4.) it shall constitute grounds for exclusion of the Participant from the giveaway, and in the event of subsequent discovery of these circumstances, including after the date of issuance of the prize, the right to claim its return.
2.16. The Organizer has the right to remove and disregard the responses to the Giveaway Tasks which:
2.16.1. violate Instagram’s terms of service;
2.16.2. contain offensive language, pornographic content, content promoting racial, ethnic, or religious hatred, or discriminating against social groups, violating the personal rights of individuals or third parties or the Organizer;
2.16.3. are created from fictitious accounts/profiles on Instagram;
2.16.4. are submitted in violation of the Giveaway Regulations or do not meet the criteria set out in the Giveaway Regulations.
2.17. Comments being response to the giveaway participation must not contain content that breaks the law, violates decency and dignity of others.
§3. GIVEAWAY PRIZE
3.1. The prize in the MISSOGNO Pawtastic Dreams Giveaway is one bed of the winner’s choice (color and size) available on the store www.missogno.com excluding wooden products.
3.2. The wooden collection, involving Lotus Oak, Lotus American walnut, Hoya Oak is excluded from being the prize in the giveaway.
3.3. The Organizer reserves the right not to argue the selection of comment of the winner.
3.4. The winner of the giveaway will be notified of the win via Direct Message via Instagram on the 2nd of September 2024 and publicly on Instagram story on the Organizer’s profile: @missognoofficial To receive the prize, the winner has to reply to a message and provide the data necessary for the shipping, which include: first and last name, street address and house/apartment number, town/city, postcode, country, email address, phone number (for courier).
3.5. The provision of incomplete or incorrect data or failure to fulfill the obligations of §3 point 3.4. within 7 working days, the Winner loses the right to the Prize.
3.6. The winner cannot transfer the right to the prize to another person.
3.7. The equivalent of the Prize cannot be paid.
3.8. In case the winner remises (refuses) to receive the prize, the Organizer has the right to give the Prize to another Participant (chosen by the Organizer) who was taking part in the giveaway and fulfilled the giveaway task.
3.9. The shipping cost of the prize to the winner is fully covered by the Organizer.
§4. PERSONAL DATA PROCESSING
4.1. The Administrator of Participants’ personal data is online shop www.missogno.com, run by a company named MS Notion Spółka Cywilna Marlena Brykała, Sabina Stańczyk with its headquarters in Dębica, address: ul. Strażacka 10/66, 39-200 Dębica, NIP [Taxpayer Identification Number]: 8722449044, REGON [National Business Registry Number]: 528721021, contact email: contact@missogno.com.
4.2. Participation in the giveaway is voluntary, but providing personal data by the Participant is voluntary yet necessary to participate in the giveaway.
4.3. The Organizer uses Participants’ personal data including: Instagram account’s name, first and last name, street address and house/apartment number, town/city, postcode, country, email address, phone number (for courier).
4.4. The Organizer uses Participants’ personal solely for purposes related to the giveaway that are:
4.4.1. the participant’s right to receive the Prize;
4.4.2. announcing the giveaway’s winner;
4.4.3. shipping the prize to the winner;
4.4.4. issuing the prize;
4.4.5. handling any complaints;
4.4.6. for accounting purposes; (art. 6, point 1b of GDPR).
4.5. The Organizer will delete all personal data after the time for complaints submission has expired.
4.6. All personal data processed as a result of the giveaway can be accessed, corrected, deleted, restricted, objected to, transferred to another service, or have consent withdrawn at any time by the person to whom the data belongs.
4.7. The giveaway task proper completion means that all the Participants accepts Giveaway Regulations without signing any separate statements of its acceptance and it also confirms that Participants agree to the Giveaway’ declarations and commitments.
4.8. The giveaway task is a Participant’s original and individual work.
4.9. The submitted work, being an answer to the giveaway question, is not restricted or claimed by any third parties. The Participant fully owns it.
4.10. Using the giveaway task by MISSOGNO, as stated in the Giveaway Regulations, will not harm or violate any rights or secrets. The Participant agrees that MISSOGNO can use the giveaway task for advertising on any media or platform (as per the consent below).
4.11. No moral rights will be asserted by the Participant against the Organizer regarding the giveaway task.
§5. FINAL PROVISIONS
5.1. The Organizer may post a summary of the Giveaway Regulations on Instagram or the Organizer’s website for informational purposes. However, only the full Giveaway Regulations and applicable laws have legal authority.
5.2. It is possible for the Organizer to change the Giveaway Regulations as long as it doesn’t affect participants’ existing rights. If any part of these Regulations is changed or canceled by a legal authority, the rest of the Regulations will still apply to both the Organizer and Participants.
5.3. In case of any complaints regarding the conduction of the MISSOGNO Pawtastic Dreams Giveaway, the issues may be submitted by Participants:
a) to the following email address: contact@missogno.com.
b) in writing to: ul. Strażacka 10/66, 39-200 Dębica, Poland
no later than 7 (seven) days from the end date of the Giveaway.
5.4. Upon receiving the complaint, the Organizer will send a response within 14 days to the email address given by the Customer or by registered mail.
5.5. The winner has the right to file a warranty complaint if the product has any physical or legal defects, just like any other customer of the store. The warranty of the product is valid within 12 months from the date of delivery of the product to the winner.
5.6. The protection of Participants’ personal data is governed by the Privacy Policy, which is part of these Regulations.

§2. DISCOUNT CODES:
